A Maintenance fee is a charge paid on a regular basis in order to maintain property. In real property law, maintenance fees are usually encountered while maintaining condominium units. Unit owners are usually charged on a monthly basis. The amounts collected will be collated and deposited in a particular account. Common practice usually holds the secretary of the condominium juristic person as the officer tasked with holding the fund. The maintenance fee usually answers for expenses such as taxes, common service expenses and maintenance of unsold units. As a rule, condominium unit owners may determine for themselves through a vote what items the fund may be used for. Certain items however, as previously stated, have already been determined by law. Unit owners may even exercise their power to resist any additional collection of maintenance fees in the guise of emergency funds if he or she determines that there is no need for further levy.
